By accessing and using Revivya ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
2. Age Requirement
Our services are available for individuals aged 18 years or older. If you're under the age of 18, you are not authorized to use our Services.
3. User Conduct
You are solely responsible for all the content you upload, post, publish or display on our Services. You agree not to use our Services to:
- Infringe any intellectual property or other proprietary rights of any party;
- Upload content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or unlawful;
- Harvest or collect email addresses or other contact information of other users from the Services by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
- Further or promote any criminal activity or enterprise or provide instructional information about illegal activities;
4. Commercial Use
The Service is for your personal use only. Unless otherwise expressly authorized by us, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Services, use of the Services, or access to the Services.
5. Indemnity
You agree to indemnify and hold the Company harmless from any from any and all losses, damages, expenses, including reasonable attorneys' fees, rights, claims, actions of any kind and injury arising out of or relating to your use of the Services, your violation of these Terms of Service, or your violation of any rights of another.
6. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express, implied, or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
7. Subscriptions
7.1 Revivya offers two types of subscription services:
- Revivya Premium Monthly: Priced at $19.99 per month.
- Revivya Premium Weekly: Priced at $5.99 per 7 days.
7.2 Subscriptions are billed in advance and are non-refundable for the subscription period they are purchased for. The subscription fee will be charged to your chosen payment method. Upon payment, you will have access to the subscribed service during the period of the subscription.
7.3 At the end of each billing cycle, your Subscription will automatically renew under the same conditions unless you cancel it or Revivya cancels it. You may cancel your Subscription renewal through your online account management page or by contacting our customer support team at [email protected] (must occur a minimum of three (3) days prior to the renewal date to avoid subsequent billing).
7.4 A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide Revivya with accurate and complete billing information and notify us immediately of any changes to such information.
8. Limitation of Liability
To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for loss of profits including but not limited to, damages for loss of goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) your use or the inability to use the service; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the service; or (iv) any other matter relating to the service.
In no event will our total liability to you for all damages, losses or causes of action exceed the amount you have paid us in the last six (6) months, or, if greater, one hundred dollars ($100).
9. Your Privacy
At Revivya, we respect the privacy of our users. By using the Service, you consent to our collection and use of personal data as outlined in our Privacy Policy.
10. Copyright Complaints
We respect the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify us of your infringement claim in accordance with the procedure set forth below.
We will process and investigate notices of alleged infringement and will take appropriate actions under the applicable intellectual property laws with respect to any alleged or actual infringement. A notification of claimed copyright infringement should be emailed to our Copyright Agent at [email protected] (Subject line: "DMCA Takedown Request").
